Agreement between User and Crystal Star Math & Science Tutoring Inc.
Welcome to https://www.cstartutor.com (the “Platform”). The Platform is operated by Crystal
Star Math & Science Tutoring Inc., a validly registered corporation under the laws of Ontario,
Canada. These Terms & Conditions (the “Terms”) govern your use of the Platform, including all
services, subscriptions, and transactions.
By accessing or using the Platform, you agree to be legally bound by these Terms. If you do not
agree, you must discontinue using the Platform. Please review these Terms carefully and retain a
copy for your records.
1. Description of Services
The Platform is an online educational platform that connects teachers (“Tutors”) and students
(“Students”) for the purpose of teaching and learning Mathematics, Science, and other academic
subjects.
• Tutors may set their own rates, schedules, and offer group or individual classes.
• Students may book and pay for classes directly through the Platform.
• The Platform pays Tutors 80% of the class fee and retains 20% as an administrative service
fee.
• No in-person classes are permitted through this Platform.
2. Electronic Communications
By using the Platform, you consent to receive electronic communications, including agreements,
notices, and other information, which satisfy any legal requirement that such communications be
in writing (per the Electronic Commerce Act, 2000 (Ontario)).
3. Account Responsibilities
You are responsible for maintaining the confidentiality of your account credentials and for all
activities under your account. You may not share, sell, or transfer your account to another person.
The Platform is not responsible for unauthorized access resulting from compromised account
information. We may suspend or terminate accounts at our discretion for breach of these Terms or
misuse of the Platform.
4. Age Requirements
The Platform does not knowingly collect personal information from children under the age of 13.
If you are under 18, you must use the Platform under the supervision and with the consent of a
parent or legal guardian.
5. Cancellation and Refund Policy
• Class purchases may be cancelled at any time.
• Cancellations made within 30 days of purchase will receive a full refund.
• Cancellations made after 30 days will receive a 50% refund.
• All class credits expire 6 months from the purchase date and are non-refundable
thereafter.
• Students may reassign unused class credits to another Tutor within the Platform.
Refunds are processed in compliance with the Consumer Protection Act, 2002 (Ontario) and
any applicable federal consumer protection standards.
6. Privacy and Data Protection
We collect, use, and store personal information in compliance with the Personal Information
Protection and Electronic Documents Act (PIPEDA) and other applicable Canadian privacy

7. Intellectual Property
All Platform content (including logos, graphics, text, and software) is owned by Crystal Star Math
& Science Tutoring Inc. or its licensors and is protected under the Copyright Act (Canada) and
international copyright laws.
You may not reproduce, modify, or distribute Platform content without express written consent.
Your access is licensed, not sold.
8. Acceptable Use
You agree not to:
• Use the Platform for unlawful purposes or in violation of these Terms.
• Attempt to hack, reverse engineer, or disrupt the Platform.
• Harass, defame, or infringe on the rights of other users.
• Upload malicious code or infringing materials.
We reserve the right to suspend or terminate accounts engaged in prohibited activities without
notice.
9. Communication Services
If the Platform offers chat rooms, forums, or messaging services, you agree to use them responsibly
and in compliance with Canadian law. We may moderate or remove content that is unlawful,
harmful, or inappropriate.
10. User Submissions
By submitting content (such as reviews, suggestions, or uploaded material), you grant the Platform
a worldwide, royalty-free, non-exclusive license to use, display, and distribute such content for the
purpose of operating and improving the Platform.
11. Third-Party Links and Services
The Platform may contain links to third-party websites. We are not responsible for their content,
privacy practices, or transactions. Use of third-party sites is at your own risk.
12. Indemnification
You agree to indemnify and hold harmless Crystal Star Math & Science Tutoring Inc., its officers,
employees, and contractors from any claims, losses, or damages arising from your use of the
Platform, breach of these Terms, or violation of any law.
13. Limitation of Liability
To the fullest extent permitted by Ontario and Canadian law:
• We provide the Platform “as is” without warranties of any kind.
• We are not liable for any indirect, incidental, or consequential damages (including loss of
data, profits, or business opportunities).
• Our total liability to you shall not exceed the total amount you paid for classes in the 6
months prior to the claim.
• Each Tutor acknowledges and agrees that they operate as an independent contractor and
not as an employee, agent, or representative of the Platform. The Platform assumes no
responsibility, obligation, or liability whatsoever in connection with any services rendered
by a Tutor, whether or not the Tutor holds professional liability insurance or any other form
of insurance coverage.
• While the Platform encourages Tutors to obtain and maintain appropriate professional
liability insurance, the Platform does not require, verify, monitor, or guarantee the
existence, validity, adequacy, or currency of any insurance held by any Tutor. Whether a
Tutor chooses to obtain insurance is solely a matter of the Tutor's own independent
judgment and risk assessment.
• The Platform shall not be liable, directly or indirectly, for any claims, losses, damages,
costs, expenses, or liabilities of any nature whatsoever arising out of or in connection with:
(a) any act, omission, negligence, or misconduct of a Tutor in the course of providing
tutoring services;
(b) any failure by a Tutor to hold, maintain, or renew professional liability insurance or any
other insurance; or
(c) any insufficiency or lapse of a Tutor's insurance coverage, regardless of whether the
Platform was aware of such insufficiency or lapse.
• Each Tutor shall indemnify, defend, and hold harmless the Platform, its affiliates, officers,
directors, employees, and agents from and against any and all claims, demands, actions,
losses, damages, liabilities, costs, and expenses (including reasonable legal fees) arising
out of or relating to the Tutor's provision of services through the Platform, the Tutor's
breach of any applicable law or regulation, or the Tutor's uninsured or underinsured liability
exposure.
• The Platform makes no representation to students, parents, guardians, or any other third
party that any Tutor is insured, licensed, certified, or otherwise qualified beyond what is
expressly stated in the Tutor's profile. Users of the Platform engage Tutors at their own
risk.
(Some provinces may not allow certain limitations of liability; in such cases, the limitation applies
to the extent permitted by law.)
14. Dispute Resolution & Arbitration
Any dispute that cannot be resolved informally shall be resolved by final and binding arbitration
in accordance with the Arbitration Act, 1991 (Ontario) through a recognized Canadian
arbitration body such as the ADR Institute of Canada (ADRIC) or the Canadian Arbitration
Association (CAA).
• Location: Brampton, Ontario (or another mutually agreed location).
• Class Action Waiver: Disputes will be resolved on an individual basis only.
15. Governing Law
These Terms are governed by the laws of Ontario and the federal laws of Canada applicable
therein. You agree to the exclusive jurisdiction of Ontario courts for any dispute not subject to
arbitration.
16. Changes to These Terms
We may update these Terms from time to time. The updated Terms will be posted on this page with
a revised “Last Updated” date. Continued use of the Platform after changes constitutes acceptance
of the updated Terms.
