Agreement between User and Crystal Star Math & Science Tutoring Inc.
Welcome to https://www.cstartutor.com (the "Platform”). The Platform is operated by Crystal Star Math & Science Tutoring Inc., a validly registered corporation under the laws of Ontario, Canada. These Terms & Conditions (the "Terms”) govern your use of the Platform, including all services, subscriptions, and transactions.
By accessing or using the Platform, you agree to be legally bound by these Terms. If you do not agree, you must discontinue using the Platform. Please review these Terms carefully and retain a copy for your records.
1. Description of Services
The Platform is an online educational platform that connects teachers ("Tutors”) and students ("Students”) for the purpose of teaching and learning Mathematics, Science, and other academic subjects.
• Tutors may set their own rates, schedules, and offer group or individual classes.
• Students may book and pay for classes directly through the Platform.
• The Platform pays Tutors 80% of the class fee and retains 20% as an administrative service fee.
• Tutors must hold valid professional liability insurance to offer lessons through the Platform.
• No in-person classes are permitted through this Platform.
2. Electronic Communications
By using the Platform, you consent to receive electronic communications, including agreements, notices, and other information, which satisfy any legal requirement that such communications be in writing (per the Electronic Commerce Act, 2000 (Ontario)).
3. Account Responsibilities
You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You may not share, sell, or transfer your account to another person. The Platform is not responsible for unauthorized access resulting from compromised account information. We may suspend or terminate accounts at our discretion for breach of these Terms or misuse of the Platform.
4. Age Requirements
The Platform does not knowingly collect personal information from children under the age of 13. If you are under 18, you must use the Platform under the supervision and with the consent of a parent or legal guardian.
5. Cancellation and Refund Policy
• Class purchases may be cancelled at any time.
• Cancellations made within 30 days of purchase will receive a full refund.
• Cancellations made after 30 days will receive a 50% refund.
• All class credits expire 6 months from the purchase date and are non-refundable thereafter.
• Students may reassign unused class credits to another Tutor within the Platform. Refunds are processed in compliance with the Consumer Protection Act, 2002 (Ontario) and any applicable federal consumer protection standards.
6. Privacy and Data Protection
We collect, use, and store personal information in compliance with the Personal Information Protection and Electronic Documents Act (PIPEDA) and other applicable Canadian privacy laws. For details, please review our Privacy Policy.
7. Intellectual Property
All Platform content (including logos, graphics, text, and software) is owned by Crystal Star Math & Science Tutoring Inc. or its licensors and is protected under the Copyright Act (Canada) and international copyright laws.
You may not reproduce, modify, or distribute Platform content without express written consent. Your access is licensed, not sold.
8. Acceptable
Use You agree not to:
• Use the Platform for unlawful purposes or in violation of these Terms.
• Attempt to hack, reverse engineer, or disrupt the Platform.
• Harass, defame, or infringe on the rights of other users.
• Upload malicious code or infringing materials.
We reserve the right to suspend or terminate accounts engaged in prohibited activities without notice.
9. Communication Services
If the Platform offers chat rooms, forums, or messaging services, you agree to use them responsibly and in compliance with Canadian law. We may moderate or remove content that is unlawful, harmful, or inappropriate.
10. User Submissions
By submitting content (such as reviews, suggestions, or uploaded material), you grant the Platform a worldwide, royalty-free, non-exclusive license to use, display, and distribute such content for the purpose of operating and improving the Platform.
11. Third-Party Links and Services
The Platform may contain links to third-party websites. We are not responsible for their content, privacy practices, or transactions. Use of third-party sites is at your own risk.
12. Indemnification
You agree to indemnify and hold harmless Crystal Star Math & Science Tutoring Inc., its officers, employees, and contractors from any claims, losses, or damages arising from your use of the Platform, breach of these Terms, or violation of any law.
13. Limitation of Liability
To the fullest extent permitted by Ontario and Canadian law:
• We provide the Platform "as is” without warranties of any kind.
• We are not liable for any indirect, incidental, or consequential damages (including loss of data, profits, or business opportunities).
• Our total liability to you shall not exceed the total amount you paid for classes in the 6 months prior to the claim.
(Some provinces may not allow certain limitations of liability; in such cases, the limitation applies to the extent permitted by law.)
14. Dispute Resolution & Arbitration
Any dispute that cannot be resolved informally shall be resolved by final and binding arbitration in accordance with the Arbitration Act, 1991 (Ontario) through a recognized Canadian arbitration body such as the ADR Institute of Canada (ADRIC) or the Canadian Arbitration Association (CAA).
• Location: Brampton, Ontario (or another mutually agreed location).
• Class Action Waiver: Disputes will be resolved on an individual basis only.
15. Governing Law
These Terms are governed by the laws of Ontario and the federal laws of Canada applicable therein. You agree to the exclusive jurisdiction of Ontario courts for any dispute not subject to arbitration.
16. Changes to These Terms
We may update these Terms from time to time. The updated Terms will be posted on this page with a revised "Last Updated” date. Continued use of the Platform after changes constitutes acceptance of the updated Terms.
